Beware the perils of face book and divorce

More and more I see an increase in the number of my clients relying on their spouse’s Face book posts and pictures. These can provide compelling evidence.

You may find out that your partner is in another relationship or you may be able to piece together from information on face book a financial position that is very different to the one which your partner is portraying.

Your former partner may be letting slip through casual posts on face book perhaps a picture of a new car or jewellery bought for a new partner, details of a job promotion or holiday. These could be used by a spouse to support a claim for a greater share of the assets on divorce or maintenance
Even if you went through divorce some time ago , if you are paying child support or maintenance to your former spouse a Face book entry could still land you in trouble. Posting details of a salary increase, a lottery win or even details of an inheritance could encourage your ex to seek an increase in the payments or even a lump sum capitalising the maintenance.
Even a photo of you with your new partner – and especially if the children are included – may antagonise your spouse and make it harder to agree a financial settlement or, more importantly, to agree arrangements to see children. Ex partners may even use social media as a forum to openly  criticise you by sending or posting nasty emails and texts. Do not fall into this trap because it can have serious repercussions leading to police involvement and even possibly proceedings against you for harassment or libel.
The moral of the tale is to think very carefully about using social media and the potential ramifications if you are involved in a divorce or other family dispute. Social media platforms create a record of your life and could be used as evidence against you in the future.
