What if your earn more than your husband?
Over the past few years there has been a rise in female breadwinners in the UK. The level of female breadwinners has increased by 80% over the past 15 years.
In the eyes of the court the role of “homemaker” and “breadwinner” are viewed as equal. When obtaining a financial settlement the objective is to ensure the financial settlement is fair to both spouses and the contribution of the homemaker will be viewed as equal to that of the breadwinner.
However, what about in cases where the wife has been the main breadwinner and alongside that has also maintained the home and brought out the children? Not unsurprisingly, in these circumstances, some wives feel hard done by and feeling as though their financial settlement is not a fair reflection of the contribution which they made to the marriage.
In a recent case the case where a husband was working part time was examined. This resulted in him earning less than his wife and the court considered it fair and right that he could go back to work full time. The husband is appealing the decision. He is advancing the argument that many wives would in his position, that he has not worked properly for 11 years and they made a mutual choice in respect of whose career should be prioritised. The court will look at the earning capacity of those who do not work, or only work part time, when considering an appropriate settlement.
