The pros and cons of an on line divorce

When searching for a divorce on line there are an array of different websites offering “A quickie divorce for just £99” . You could be forgiven for believing that the divorce process is quick and easy and that there is no need to instruct a lawyer – who would in these circumstances?

A DIY divorce can be a cheap and easy option for some. The scenario best suited to this type of divorce is where there is good communication between both parties, there are no children, no financial assets to split and your divorce is uncontested. However, this type of scenario applies to very few.

Often when a marriage breaks down, communication can be very difficult and this can hinder the divorce process.

Here are our tips for what to look out for with on- line, quickie divorces:

Hidden fees

The fee advertised is often not the full story and quoted merely to entice you in. In addition to the cost for processing the divorce, there is a court fee payable which has just rocketed up to £550.00.

In addition there may be further fees payable as different stages are reached in the divorce process for example, applying for the decree nisi or the decree absolute.

Financial settlements

In order to save on costs you may have reached an agreement with your partner about how the assets of the marriage are o be divided.

You may have agreed matters between yourselves and know exactly how you want to proceed in relation to splitting your matrimonial assets.

Until the agreement is enshrined into a consent order and presented to the court on the pronouncement of decree nisi the agreement that you have reached may not be worth the paper that it is written on.

Unless you have a consent order, approved by the court the whole issue of finances can be resurrected at any point in the future.

The costs of drawing up the consent order certainly will not be covered by the £99.00 fee advertised.

 Acting in haste

Attempting to conclude the divorce as quickly and cheaply as possible is of course an attractive option for some. It is important to make sure that you seek independent legal advice because if you don’t it could end up costing you more in the long run!
