We have agreed a financial settlement – what is the next step?

When you reach a financial agreement it is necessary for this to be encapsulated into a consent order to be approved by the court.

The court fee for approving the consent order currently stands at £50.00. In addition to this I charge a range of fixed fee packages, depending on the complexity of the drafting work required.

A clean break is a clause in a consent order which dismisses rights to make any future claims against the income, capital or pension provision arising out of your marriage. Depending on the agreement that you reach you can have a clean break order for one or both of you.

A consent order will deal with issues like what is to happen to any property of the marriage. Will a house need to be sold or transferred to the other party? Particular provisions can be drafted according to your particular circumstances.

If the District Judge that considers the consent order as to its appropriateness and fairness has sufficient information then it is usually possible for the order to be approved without the need to attend at court. However, if one party is not represented by a solicitor a District Judge may require a short hearing to ensure that the unrepresented party understands the nature of what it is that they are signing up to.

In addition to the consent order there is a document called a statement of information for a consent order. This sets out all of the information which a judge requires in order to decipher whether or not the agreement is fair and reasonable. The statement of information requires that capital, liabilities and pensions are listed. In addition you are required to disclose the details of your net monthly income. There is also a section requiring background information to the marriage to include the ages of the parties, the date of marriage and date of separation and the dates of birth of any children.

It is vital that your consent order contains all of the information required to protect you and to safeguard your financial future and consequently very important that it is drafted by a solicitor or a barrister.
